43-year-old Michael Annese parked in front of a Maxwell Avenue residence’s driveway, blocking it in the early hours of July 19th. The resident called 911, and when officers arrived, he told them that the vehicle in question had been sitting there for some time. Officers approached Annese, who seemed confused and was “acting strange.” Due to his behavior, officers asked him if he had been drinking, to which he replied, “Yes.” Annese advised officers that he was sitting in his car until he felt safe to drive. Officers had him exit the vehicle, where he showed signs of intoxication and reeked of alcohol. Officers prompted Annese with sobriety tests, and he agreed. While performing the tests, Annese repeatedly stopped and told officers he wasn’t driving. After performing poorly, he was Mirandized and informed of implied consent. Annese refused to provide a chemical sample and was taken into custody for driving under the influence and an implied consent violation.
